Terms & Conditions — the rules for using the app

Acceptance of Terms #

These Terms govern your use of the Technology HD Wallpapers app (the "Service") operated by Pinaki Nexus ("we", "us") on Android and on iPhone/iPad. By installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

The Service #

The Service lets you browse, download, share and set wallpapers (on iPhone/iPad, save them to Photos and set them from there), request new wallpapers and receive notifications. It is free and supported by ads. Features, content and availability may change, be added or be removed at any time.

Licence and Use of Content #

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service and its wallpapers on your own devices for personal, non-commercial use. You may not resell, redistribute, publish in other apps or websites, or use the wallpapers commercially.

Some wallpapers depict third-party characters, people, logos or trademarks. These belong to their respective owners; they are shown for personal decoration only and no affiliation or endorsement is implied.

Pro Upgrade and Payments #

Pro is an optional one-time, lifetime purchase that removes ads and unlocks premium features in the app you bought it in, on that device. It is not a subscription and does not renew.

On iPhone/iPad, Pro is purchased only through Apple In-App Purchase and billed to your Apple ID. On Android it is purchased through Google Play or, where offered, Razorpay. The price shown at checkout (in your local currency where available) is the price charged. Taxes may apply. Refunds are covered by our Refund Policy.

Credits and Virtual Items #

Credits or similar in-app rewards have no cash value, cannot be sold, transferred or exchanged for money, and may be changed, expire or be reset as the Service evolves.

Acceptable Use #

You agree not to:

  • copy, scrape or bulk-download content, or access the Service through bots or automated scripts;
  • reverse-engineer, modify or tamper with the app, or interfere with ads, payments or security;
  • submit requests or messages that are unlawful, abusive, hateful, sexually explicit or infringe others' rights;
  • attempt to obtain Pro, credits or other benefits through fraud or chargebacks.

We may suspend or terminate access for users who break these Terms.

Advertising and Third Parties #

The Service shows ads from third parties and may link to third-party websites or apps. We are not responsible for their content, products or practices.

Disclaimer #

The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that it will be uninterrupted, error-free or that every wallpaper will remain available.

Limitation of Liability #

To the maximum extent permitted by law, Pinaki Nexus is not liable for any indirect, incidental or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for Pro, if any.

Additional Terms for iPhone/iPad (App Store) #

If you downloaded the Service from Apple's App Store:

  • These Terms are between you and Pinaki Nexus only, not Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Service and its content.
  • Your licence is limited to using the Service on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to provide maintenance or support for the Service.
  • If the Service fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law Apple has no other warranty obligation. Any other claims, losses or costs from a failure to conform are our responsibility.
  • We, not Apple, are responsible for addressing any claims relating to the Service, including product liability, failure to meet legal or regulatory requirements, and consumer-protection or privacy claims.
  • We, not Apple, are responsible for investigating, defending, settling and discharging any third-party claim that the Service infringes that party's intellectual property rights.
  • You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing Law #

These Terms are governed by the laws of India. Disputes are subject to the jurisdiction of the courts of India, without affecting any mandatory consumer rights you have in your country.

Changes to These Terms #

We may update these Terms. Continued use of the Service after changes means you accept the updated Terms.
